Terms of Service

These Terms of Service (“Terms”) govern your use of Mode (“Mode”, “we”, “us”), operated by a sole trader based in Australia. By using Mode, you agree to these Terms. If you don’t agree, please don’t use the service.

1. Eligibility

You must be at least 18 years old to use Mode. By using the service you confirm that you are 18 or over.

2. What Mode is

Mode provides AI companions for purposes such as building, creativity, and interactive storytelling. The companions are AI — not real people, and not professionals. Mode is not a dating, romantic, or adult service.

3. Not professional advice

Mode does not provide medical, legal, financial, or other professional advice. AI responses can be inaccurate, incomplete, or out of date. Don’t rely on Mode for important decisions — always check with a qualified professional. Mode is not a crisis or emergency service; if you are in danger or crisis, contact local emergency services or a crisis line.

4. Acceptable use

You agree not to use Mode to:

  • Break the law or encourage others to.
  • Generate content that sexualises minors, or any illegal content.
  • Harass, abuse, or harm others, or attempt to harm yourself or others.
  • Attempt to bypass safety measures, usage limits, or security.
  • Reverse-engineer, scrape, or disrupt the service.
  • Resell or misrepresent the service.

We may suspend or terminate accounts that breach these Terms.

5. Your content

You own the messages you submit. By using Mode, you give us permission to process your messages to operate the service (including sending them to our AI provider to generate responses). You’re responsible for what you submit and for keeping your account secure.

6. Subscriptions and payments

  • Mode offers a free tier and a paid subscription (Founder Plus).
  • Paid subscriptions are billed in advance on a recurring basis through our payment provider, Stripe.
  • You can cancel any time through the billing page. Cancellation takes effect at the end of your current billing period, and you keep access until then.
  • Prices may change; we’ll give notice of changes and won’t increase your price without your consent.
  • Except where required by law (including under the Australian Consumer Law), payments are generally non-refundable for partial periods.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or guarantees you have under the Australian Consumer Law that cannot be excluded. Our liability for failing to meet a consumer guarantee is limited, where permitted, to re-supplying the service or paying the cost of re-supply.

8. Service availability

Mode is provided on an “as is” and “as available” basis, and is currently in early access / beta. Features may change, break, or be removed, and the service may be unavailable at times. We don’t guarantee uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law (and subject to section 7), we are not liable for any indirect, incidental, or consequential loss arising from your use of Mode. Our total liability is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You can stop using Mode and delete your account at any time. We may suspend or end your access if you breach these Terms or if we stop operating the service.

11. Changes to these Terms

We may update these Terms from time to time. If we make significant changes, we’ll update the date above and, where appropriate, notify you. Continuing to use Mode after changes means you accept them.

12. Governing law

These Terms are governed by the laws of Australia, and you submit to the courts of Australia for any disputes.
